Movygo Ride Terms & Conditions

These Ride Terms govern passenger transportation requested through the Ride functionality of the Movygo platform. They supplement the Movygo Customer Terms of Service, Driver Terms of Service, Privacy Policies, and applicable platform policies. Where these Ride Terms specifically address passenger transportation, they control over inconsistent general provisions concerning the same subject.

1. Platform and Transportation Relationship

Movygo Inc. ("Movygo") operates a technology platform through which Passengers may request transportation from eligible independent Drivers. The underlying transportation service is provided by the Driver to the Passenger. The Driver is responsible for operating the vehicle and performing the transportation service.

Movygo provides technology and related platform functions including digital dispatch, matching, booking, fare calculation, electronic payment, location and trip functionality, communications, receipts, and records necessary to operate the platform. Movygo does not own or operate the Driver's vehicle and does not become the operator of the vehicle merely because transportation is requested, dispatched, tracked, or paid through Movygo. Nothing in these Ride Terms excludes any responsibility imposed directly on Movygo by applicable law.

2. Driver Responsibilities

Approval to access Ride requests does not constitute a guarantee by Movygo concerning a Driver's future conduct.

3. Passenger Responsibilities

The account holder is responsible for persons travelling under the account holder's booking to the extent permitted by law.

4. Driver and Vehicle Identification

Before entering the vehicle, the Passenger should verify identifying information displayed through Movygo, which may include Driver first name, Driver photograph, vehicle make/model/colour, licence plate and estimated arrival time. A Passenger should not knowingly enter a materially different vehicle and should report material discrepancies through the available reporting process.

5. Ride Acceptance

A Ride request does not guarantee that a Driver will accept or complete the request. A Driver may accept or decline available Ride requests subject to applicable law and platform requirements. Once accepted, the Driver and Passenger arrange the underlying transportation through the Movygo platform.

6. Fares

Before a Ride begins, Movygo may display an estimated or quoted amount. The fare may consider base fare, distance, estimated duration, Ride category, minimum fare, booking/platform fees, waiting, additional stops, tolls, airport charges, regulatory charges, applicable taxes and other disclosed charges. Where the platform identifies a price as an estimate, the final amount may differ as permitted by these Terms and applicable law.

7. Fare Adjustments

The final fare may change for disclosed circumstances including Passenger-requested destination changes or additional stops, additional waiting, additional distance or duration resulting from Passenger-requested changes, tolls, airport charges, applicable taxes or regulatory charges, and other disclosed adjustments. Movygo does not guarantee that traffic, road closures, weather, construction, GPS information or travel times will match estimates.

8. Payment Authorization

By requesting a Ride, the Passenger authorizes Movygo and its payment providers to place a temporary authorization hold on the selected payment method. The authorization may reasonably exceed the initial estimate to accommodate permitted adjustments. An authorization hold is not necessarily a completed charge. Following completion, the amount properly due may be captured and unused authorization released according to payment-provider and financial-institution processing timelines. Where supported, an increased authorization may be requested if the permitted final amount exceeds the existing authorization.

9. Electronic Payment

Payment for a Ride must be made through an authorized Movygo payment method where required by the platform or applicable law. A Driver must not require unauthorized cash, electronic transfer or other off-platform payment for a Movygo Ride. Movygo may facilitate collection and settlement of the transportation fare and other applicable amounts.

10. Tips

Tips are voluntary unless expressly stated otherwise. Where tipping is available, the Passenger determines whether and how much to tip. A voluntary tip designated for the Driver is intended for the Driver, subject to payment processing and applicable law.

11. Cancellations and No-Shows

Passengers and Drivers may cancel subject to the cancellation terms disclosed through the platform. A disclosed cancellation, waiting or no-show charge may apply. A Passenger may be considered a no-show after the Driver reaches the designated pickup point, the applicable waiting period expires and the Passenger does not appear. Nothing requires a Driver or Passenger to continue transportation where continuing would reasonably be unsafe or unlawful.

12. Safe Transportation

The Driver is responsible for safe operation of the vehicle. Passengers must not interfere with vehicle controls, dangerously distract the Driver, request speeding or unlawful driving, threaten or assault the Driver, intentionally damage the vehicle, or engage in conduct creating a serious safety risk. Either party may request that transportation end at a reasonably safe location where continuing presents a legitimate safety concern.

13. Seatbelts and Passenger Capacity

Drivers and Passengers must comply with applicable seatbelt and vehicle-occupancy laws. Passengers must not request transportation exceeding the lawful or safe capacity of the vehicle.

14. Children

The Passenger or accompanying responsible adult is responsible for complying with applicable child-passenger and child-restraint requirements. Unless expressly offered as a separate service, Movygo does not provide child-restraint equipment. A Driver is not required to begin transportation where doing so would violate applicable child-safety law.

15. Animals and Accessibility

Ordinary pets are governed by the Ride Animals, Service Animals & Accessibility Policy. Service animals are not ordinary pets. Nothing in these Terms authorizes conduct inconsistent with applicable accessibility or human-rights law.

16. Passenger Property and Lost Property

Passengers remain responsible for personal property brought into the vehicle and should inspect the areas they used before leaving. Neither Movygo nor the Driver guarantees recovery of forgotten property.

Movygo provides a process through which a Passenger may report property believed to have been left in a Driver's vehicle and may facilitate communication or return arrangements. Movygo does not take possession, custody or ownership of the property merely because a report is submitted and does not guarantee that an item will be located, preserved or returned. The Driver and Passenger remain responsible for lawful handling and return arrangements.

17. Cleaning and Vehicle Damage

Passengers are responsible, to the extent permitted by law, for extraordinary cleaning or physical damage they or persons travelling under their booking cause to the Driver's vehicle. Normal use, ordinary dirt, ordinary wear and routine vehicle maintenance remain the Driver's responsibility. Ride cleaning and damage matters are governed by the Ride Cleaning & Vehicle Damage Policy.

18. Smoking, Vaping and Substances

Drivers and Passengers must comply with applicable smoking and vaping laws. A Driver must not provide transportation while impaired or otherwise unable to operate the vehicle safely. Passengers must comply with applicable laws concerning possession, consumption and transportation of alcohol, cannabis and other substances. A Driver may end a Ride at a reasonably safe location where Passenger conduct creates a genuine safety concern.

19. Violence, Threats, Harassment and Discrimination

Drivers and Passengers must not engage in violence, threats, stalking, sexual misconduct, unwanted sexual contact, intimidation, harassment or other unlawful conduct. They must comply with applicable human-rights and accessibility laws. A person facing an immediate threat should contact 911 or the appropriate emergency authority. Movygo is not an emergency response service.

20. Insurance

Drivers are responsible for maintaining insurance required to provide passenger transportation. Movygo may collect or verify insurance information where required for platform or regulatory purposes. Such review does not constitute a guarantee by Movygo that a particular loss will be covered. Insurance coverage and claims are governed by applicable policies and law.

21. Taxes

Drivers remain responsible for tax obligations applicable to transportation services they provide except to the extent Movygo is legally required or expressly authorized to collect, report, withhold or remit an amount. Movygo may process taxes associated with the transportation transaction and taxes associated with Movygo's own fees according to applicable law.

22. Location and Trip Information

Ride functionality requires processing of location and trip information. Depending on Ride status and user role, Movygo may process pickup and destination, precise location, Driver location while available for Ride requests, route, stops, trip timestamps, distance, duration, arrival information and related operational records.

This information may be used for matching, dispatch, navigation, ETA, live tracking, trip administration, fare calculation, safety, fraud prevention, dispute handling and legal or regulatory requirements. Relevant trip information may be shared between the matched Driver and Passenger where necessary to facilitate the Ride.

23. Platform Availability

Movygo does not guarantee Driver availability, acceptance of a Ride request, uninterrupted platform availability, GPS or map accuracy, mobile network availability, exact arrival times or uninterrupted operation of third-party technology. The platform is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

24. Driver and Passenger Conduct

Each Driver and Passenger remains responsible for their own acts and omissions. Movygo's provision of dispatch, booking, payment, mapping, communication or other platform technology does not make Movygo the operator of the Driver's vehicle. Movygo does not guarantee the future conduct of any Driver or Passenger.

25. Disputes Between Driver and Passenger

Disputes concerning personal conduct, lost property, physical vehicle damage or other matters arising directly between Driver and Passenger remain principally between those parties, subject to applicable law. Movygo may provide reporting, complaint, evidence, payment, communication or other functionality where required by law or reasonably necessary to operate the platform. Providing such functionality does not make Movygo the provider of the underlying transportation service or a party responsible for the conduct giving rise to the dispute.

26. Emergency Situations

Movygo is not an emergency response service. For an immediate threat to life, health or safety, call 911 or the appropriate emergency authority. Any safety functionality available through Movygo supplements and does not replace emergency services.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Movygo Inc., its affiliates, directors, officers, employees and agents are not liable for indirect, incidental, special, punitive or consequential damages arising from the acts or omissions of a Driver, Passenger or other third party or from the underlying transportation service where such liability may lawfully be excluded.

Movygo does not assume responsibility for operating the Driver's vehicle merely because the Driver and Passenger were connected, dispatched, tracked, communicated or paid through Movygo.

Nothing in these Ride Terms excludes liability that cannot legally be excluded, waives non-waivable statutory rights, excludes responsibilities imposed directly upon Movygo by applicable law, or overrides applicable insurance legislation or coverage.

28. Indemnity

To the extent permitted by law, a Driver or Passenger agrees to indemnify Movygo against third-party claims, losses and reasonable costs arising directly from that person's unlawful conduct, fraud, intentional misconduct, material breach of these Terms or infringement of another person's rights, except to the extent caused by Movygo's own conduct or legal responsibility.

29. Complaints

Movygo provides a process through which Ride-related complaints concerning Drivers, vehicles, Passengers, transactions or the platform may be submitted. Movygo may review information reasonably necessary to administer the complaint process, satisfy regulatory requirements, protect platform integrity or respond to legal obligations. The availability of a complaint process does not make Movygo responsible for the underlying conduct alleged in a complaint.

30. Account Restrictions

Movygo may restrict access to Ride functionality where reasonably necessary for safety, fraud prevention, expired or invalid eligibility documents, payment risk, serious misconduct or legal/regulatory compliance. Temporary restriction while a matter is reviewed is not necessarily a final determination concerning an allegation.

31. Applicable Law

These Ride Terms form part of the applicable Movygo Customer Terms or Driver Terms. General provisions concerning governing law, dispute resolution, notices, assignment, severability and account closure remain applicable. Mandatory law in the jurisdiction where transportation occurs applies notwithstanding inconsistent contractual language.

32. Acceptance and Updates

Use of Ride functionality requires acceptance of the version of these Ride Terms presented to the user. Movygo may update these Ride Terms. Where required by law or where a material update requires renewed agreement, Movygo may require explicit acceptance before further use of Ride functionality. Movygo may retain the accepted version, timestamp and related consent records for legal, regulatory, audit and dispute purposes.
